TAXIDI APP Terms and Conditions of Use



PREAMBLE

TAXIDI APP is a software application for ordering a taxi and it facilitates taxi service requests to the taxi service providers who have been registered as users through the TAXIDI mobile application. The private limited liability company ID Taxidigital Solutions Ltd (registration number HE 356236), registered in the Republic of Cyprus, holds all the rights and is the main provider of the TAXIDI mobile service and in general terms acts as the service provider between the client/s that request such service and the provider of the relevant taxi and/or transfer service.

Using the TAXIDI APP

1.1 The use of the TAXIDI APP requires installation of the software and registration of an account as a user. During the registration in the TAXIDI APP, the email address of the user is linked to the respective user account to the database.

1.2 The user agrees that all information and details that are provided to TAXIDI APP accurate, correct and complete and failing to provide the true information as requested by the application may be result to the revocation of the right to use the application. User can update or change his/her personal details in profile section of TAXIDI app.

1.3 The user agrees to have no rights to use our intangible property rights –including all the relevant Intellectual Property rights- for any purpose of our company or our company partners or companies connected to ID Taxidigital Solutions Limited and relate to copyrighted material.

1.4 The user agrees that he/she will not use TAXIDI app for any unlawful purpose, or in a manner that it constitutes an unlawful act and/or omission and/or recklessness and/or negligence.

1.5 User agrees to never use the TAXIDI app for emergency services like medical, police and fire purposes. All emergency requests should be addressed to the Emergency Authorities Department or by dialing 112 on local phone.

TAXIDI APP payment conditions

2.1 User is allowed to choose a payment option at the end of the performed order and pay either through TAXIDI app through the registration of his/her credit card or through the use of cash to the driver the amount owed.

2.2 User agrees to make payment in full to any taxi service provider who performed the user's order in TAXIDI app and can keep the right to rate last trip and comment on it.

2.3 The user of the TAXIDI APP can pay for the taxi service via a credit card payment, which requires the prior activation of the credit card data within the app and acceptance of TAXIDI APP Terms and Conditions of Using App. The activation of the user's credit or debit card will be charged once and cost 0.10 euro cents only and this is a fee charged by the processor for the card activation. Since card submitted to the system and passed the activation it is attached to the profile of TAXIDI app. TAXIDI app does not keep any information concerning the card details

2.4 Once the user had completed the trip TAXIDI app will not be able to cancel the payment and such payment made through the credit card is non-refundable.

Exception can be only taken place when a driver by mistake finishes the order in the DRIVER APP before the destination is reached. In such case you need to contact us via email support@mytaxidi.com

2.5 When making credit card payments, the receiver of the payment is TAXIDI APP, who forwards the received payment to the taxi service provider.

2.6 The intermediation of credit card payments in the TAXIDI APP are carried out through JCC Payment Systems LTD and referred to the Terms of Use are linked on the website (http://www.jcc.com.cy/).

2.7 Although TAXIDI APP shall not be responsible for the proper functioning of the credit card payments still TAXIDI APP will offer to the card owners' minimum support in solving problems. The intermediary which deals with such queries can be contacted by the user to support@mytaxidi.com.

2.8 When offering credit card payments, TAXIDI APP acts as the economic agent of taxi service providers by intermediating payments that are made in the TAXIDI APP. The obligation of the taxi customer towards the taxi service provider shall be considered fulfilled as of the moment when the payment order is made for the payment of funds into the TAXIDI APP bank account. TAXIDI APP shall not be responsible for the exercise of the taxi customer's payment order.

2.9 Due to any problems with internet access or mobile internet connection lost or any other reasons that may arise with internet data transfer during the payment, TAXIDI mobile service shall not be held responsible

Ordering or cancelling a taxi service

3.1 If the TAXIDI APP user orders a taxi and the taxi driver has confirmed the receipt of service then the taxi is considered pre-ordered.

3.2 Cancelling the use of an ordered taxi is considered to be the situation whereas the taxi driver has notified about the receipt of an order and the TAXIDI APP user waives the taxi service after receiving such notice.

3.3 Cancelling the use of an ordered taxi is also considered to be the situation whereas the user of the TAXIDI APP or people whom the taxi was ordered for do not appear in the taxi within 10 minutes as of the time when the taxi driver notified them about the arrival of the taxi in its requested destination.

3.4 The user does not have to pay the penalty fee in case he/she effectively cancels the placed order within 5 minutes and such cancellation is communicated throughout TAXIDI APP.

3.5 We have the right to revoke the right to use the app if the user has waived the use of taxi service on 3 successive instances in one 24-hour period. In that case the app notifies the user about the number of cancellations and after waiving the 3rd time, TAXIDI APP cancels the said right. TAXIDI APP usage right can be cancelled for up to six months or for such period that is deemed fit for every particular situation. Afterwards the user can reactivate his/her user account by contacting the local team via email.



The Use of TAXIDI APP

4.1 TAXIDI APP is a mobile app enables persons require a taxi service to find a suitable provider by sharing data on their geographic location.

4.2 In case that any faults appear in the software, we shall endeavor to correct them as soon as possible, but please keep in mind that the proper functioning of the app may be restricted due to occasional technical errors and we are not able to guarantee unlimited faultless functioning of the app at all times. We shall also accept no liability for any losses incurred as a consequence of the TAXIDI APP not functioning properly or not being usable in the desired manner. In the event that the taxi customer's right to use the app is cancelled the company shall not be held liable for any sort-of losses incurred by the non-use and/or the non-performance of TAXIDI APP and we accept no liability for non-performance whatsoever.

4.3 As the TAXIDI APP is a means of communication and facilitates the communication between taxi customers and taxi service providers, TAXIDI APP cannot influence or take any responsibility for the quality or defects of the service. For this reason, we are unable to guarantee consistently accurate and faultless provision of taxi services located via TAXIDI APP. For resolving complaints please contact our support team. The taxi customers shall reserve the right to make claims against unsatisfactory service/s against the service providers directly, however the company and/or TAXIDI APP cannot be held responsible for any damage and/or loss incurred by using the specific service.

4.4 The TAXIDI APP does not constitute an offer or brokerage of taxi transportation for customers. The TAXIDI APP is not a mean for organizing the provision of transportation services. It is also not an agency service for finding customers for taxi service providers or finding taxi-services for clients, however TAXIDI APP only facilitates the communication between taxi-service user and the driver ready to offer such taxi service.

4.5 The consumer's right of a refund (withdrawal) is not applied to TAXIDI APP orders.

Register of account and the following conditions

5.1 TAXIDI APP shall have the right to add the personal data of the app user to the TAXIDI APP database and to forward the personal data to taxi service providers in accordance with TAXIDI mobile service Privacy Statement (http://mytaxidi.com/privacy-statement/).

5.2 TAXIDI mobile service has a right to make unilateral amendments to the Terms and Conditions of Using App and Privacy Statement and to resign the database to third parties. We shall notify the users of subsequent changes to Terms and Conditions of Using App and Privacy Statement and the uploading of those at the relevant Webpage will be deemed as they were communicated effectively to the user and also to the taxi service provider.

5.3 TAXIDI APP shall be entitled to transfer the database of personal data to third parties without prior notification of the app users. In case of a transfer of the business or the database, the rights and conditions arising from this license agreement shall be transferred as well. This transfer of the database will not consider infringing the Privacy of the taxi customers and/or the Service provider, since the use of both geographical information and also the use of taxi customers' private information it falls only within the scope of facilitating a requested service relevant to the services offered by the TAXIDI APP.

5.4 TAXIDI APP shall be entitled to forward personal data and bank data to credit card and mobile payment intermediaries and/or the payment gateway as referred to in article 2.6. Above.

5.5 TAXIDI APP has the right to send marketing messages and promo materials via email in case the user consents to be receiving such notifications.

Good practice of using the TAXIDI APP

6.1 As TAXIDI APP is not a provider or broker of the said taxi service and we are unable to influence the quality of the taxi service provider. Any issues that are related with defects or the quality of the service shall be resolved in accordance with the rules and regulations of the taxi service provider or the relevant supervisory authority and relevant code of conduct and relevant to the established conventions that guarantee the integrity of their discipline and/or their area of practice (such as Road & Transport regulations; Contracts; Law of Negligence; Criminal Codes; Civil Codes; The Constitution of the Republic of Cyprus and so on).

6.2 TAXIDI APP is committed to contribute to the improvement of the quality of taxi services. For this reason, the user may leave comments and rate the driver at the end of the trip in the TAXIDI APP. This enables us to offer suggestions to the taxi service providers for improving the quality of their service.

6.3 We expect that the users of the TAXIDI APP use the app in good faith and are respectful of the taxi drivers who offer their services through TAXIDI mobile service.

6.4 TAXIDI APP shall make every effort to ensure that only drivers, who have integrity and are respectful of their profession and customers, that they use the TAXIDI APP. However, we are not in the position to guarantee that every provider of taxi service/s, which are placed via the TAXIDI APP, satisfy the before said criteria at all times.
